Judge,
I have attached to this email a courtesy copy of Plaintiff Bryan Reo’s motion for expedited ruling on a motion to appoint receiver, motion to lease property, and motion to disburse funds. Essentially, Reo is asking the Court to permit the property to be leased to a willing tenant for the purposes of paying the back taxes, paying the receiver, and paying the balance toward Mr. Reo’s remaining judgment in file 58CIV19-35. Mr. Lindstedt has failed to pay his property taxes, and is now more than $11,000.00 in arrears. I was previously contacted by Tom Maher, on behalf of Stanley County, to see if something could be worked out to get the taxes paid. As Martin is the record owner of the property, but not able to lease without order of this Court, we are asking that a receiver, be appointed to collect the rental money. We are proposing the same receiver previously appointed. The attached motion contains a summary of the taxes in arrears and the proposed lease terms.
Mr. Roseth is in time crunch to get he land leased as he has cattle to turn out onto the property and the weeds are growing with all the rain. This is probably the last and best opportunity that Martin has to generate income from his property this year. Leaving the land go to weeds and tax sale serves no purpose other than devaluing the property and spiting Mr. Reo. These are not legitimate goals and a receiver should be appointed to collect and disburse the lease money as set forth in our motion.
The specifics are all contained in the motion. I would ask that you review the motion, and allow Mr. Lindstedt a brief time to respond to the extent you deem necessary in light of his veracious nature. If you are agreeable, or at least preliminarily agreeable, I can begin preparing the final order. I have reviewed the basics of this motion with Tom Maher, and he has no objection. Mr. Roseth is ready and willing to lease the property but he cannot delay much longer.
For these reasons, we request a ruling on an expedited basis based upon the written submissions of the parties. If you desire further briefing or summary, please advise.
