Attached please find a courtesy copy of Plaintiff’s Motion for release of funds held by the court. This motion was previously denied without prejudice on February 9, 2022. However, since that time, as you can see from the exhibits to the motion, the Supreme Court has dismissed Mrs. Bessman’s appeal and she has paid the judgment amount in full to the Plaintiff. A satisfaction of judgment to that effect has been filed. All claims between Reo and Bessman in file 58CIV20-07 appear to be resolved.
Regarding Mr. Lindstedt’s appeal, there is no contemplated supersedeas bond and there is no stay ordered by this court. The first couple pages of my motion address this court’s authority and jurisdiction, as I anticipate that will be your question. I believe the court is very familiar with this case, and I would ask that you grant this motion on briefs. If you agree, I can prepare an order. Of course, you may allow Mrs. Bessman and Mr. Lindstedt the opportunity to respond. If you believe a hearing is necessary, I can schedule one with Mona.
Finally your honor, now that the fraudulent transfer file is effectively wrapped up, I am inquiring as to the court’s status in issuing a ruling on Susan Bessman’s request for 60B relief in files 58CIV21-16 and 58CIV21-24. Susan Bessman, a non party, filed a Motion for Relief from Judgment Pursuant to SDCL 15-6-60B in both files on or about August 26, 2021. Plaintiff drafted and filed a brief in response. A hearing was held on or about November 24, 2021. The matter has been fully briefed and the parties are awaiting a decision in these files. Plaintiff, and I am sure likewise Mrs. Baron Houy, would appreciate some timetable for your response to these motions at your earliest convenience.
