Sentencing Delayed Until December 20th For MLK Day Backpack Bomber Kevin Harpham

Kevin Harpham, who pleaded guilty to Attempted Use of a Weapon of Mass Destruction and Attempt to Cause Bodily Injury with an Explosive Device Based on Actual or Perceived Race and National Origin of Any Person on September 7th, 2011, is back in the news once again. Harpham was to be sentenced on November 30th, but U.S. District Judge Justin Quackenbush granted a delay in pronouncing sentence until December 20th, 2011.
The reason for the delay is because Harpham's public defender, Roger Peven, who is also the executive director of the Federal Public Defenders of Eastern Washington, wants additional time to research federal definitions for a bomb or “other similar device". Specifically, Peven said he wanted additional time to ensure the bomb Harpham made matches the definition of a bomb or "similar device". Harpham's bomb is now more completely described as a pipe bomb loaded with 128 lead fishing weights coated with rat poison.
In any event, Harpham, 37, faces a sentencing range of 27 to 32 years. Before the judge granted the continuance, prosecutors were arguing for the maximum 32 years. They argue Harpham’s actions set him apart from similar cases because of his detailed planning of the bomb and white supremacist history. They maintain his history as a white supremacist suggests he will need time to reflect on his actions. They also say it is unlikely that his views will change in the short term and that the public needs to be protected from him for a long time. They also cite photos of blacks and other minorities taken by Harpham on that day to show he specifically desired to target non-Whites. All of this overrides the fact that Harpham has no prior criminal history, according to prosecutors.
In contrast, the defense argued for a lesser sentence because the bomb never went off. The defense also pointed to others with similar cases getting lesser sentences. The defense also submitted a motion saying “Mr. Harpham, who has lived an exemplary life until recent events, who has no criminal history, who has been a good son, brother, neighbor, soldier and friend deserves to have this Court take into account the good works that account for the majority of his life... He accepts responsibility for his crime and a sentence of 27 years is just punishment for his misdeeds.” It was afterwards that the defense moved for a continuance until December 20th.
KHQ Channel 6 reports that Kevin Harpham is relieved to have a cell by himself. Harpham has been in solitary confinement in the Spokane County Jail for eight months since his arrest. While in jail, Harpham's exchanged letters and post cards with VNN Forum's Frazier Glenn Miller. In one undated letter to Miller, Harpham wrote, "They have been keeping me in the hole here. It's nice to have a cell to yourself but it's highly restrictive. The worst things about jail, or at least this jail is the hard bed, limited clothes, and blankets to keep warm." According to the same letter, Harpham hoped for better conditions in prison writing that someone once told him "Federal prisons are much better than the state ones, I hope that is accurate. I also hope they are more entertaining than this place." Harpham also turned down an offer of money or a fund drive from Miller, saying that it was better to take a public defender and not squander money on a private attorney.

Not really much difference between 27 years and 32 years; Harpham will still be old enough for Medicare when he's released. The only question now is what type of federal prison will he be assigned to. Will he be sent to the supermax at Florence like Matt Hale?
