      A judge dismissed a temporary restraining order against a Leith website developer who’s publicizing activities of the white separatist movement in the tiny community.

      South Central District Judge Bruce Haskell said in Monday’s order that website developer Gregory Bruce’s actions did not constitute disorderly conduct as stated in an order sought by Deborah Henderson, the girlfriend of a white separatist affiliated with Craig Cobb.

      Cobb and Henderson’s boyfriend, Kynan Dutton, are now in jail awaiting a Jan. 13 preliminary hearing on seven charges of carrying guns on an armed patrol and terrorizing Leith residents.

      Henderson asked the judge to permanently stop Bruce, of New Leipzig, from posting pictures and information about her and others visiting Cobb’s house in Leith, where she is living.

      In court last week, Henderson gave the judge pictures and copies of comments Bruce posted on the website. She said the attention was causing her to fear for the safety of herself and her three children.

      In turn, Bruce gave the judge a video that Henderson took while following Cobb and Dutton around Leith in which she’s heard to call the exercise “chicken hunting.” The men are trying to establish a neo-Nazi stronghold in Leith and take over the town.

      Because he dismissed the restraining order for lack of disorderly conduct, the judge said he didn’t have to address whether Bruce was protected under the First Amendment.

      Still, Haskell weighed in on that point in his eight-page order.

      He said, “The court finds it interesting that Bruce cloaks himself in the right to free speech. However, the purpose of the First Amendment is not to protect majority, mainstream speech and ideas. It is to protect those with minority opinions, even if those opinions are repugnant to the majority.

      “Bruce wants the benefit of the First Amendment for himself, but is not prepared to provide it to those like Henderson with whom he disagrees,” the judge wrote.

      Bruce said he was never bothered much by the temporary restraining order, which was in effect for about a week before being dismissed.

      “This is a victory for Leith and it’s one more step in ridding Leith of the Nazi evil,” Bruce said.

      Henderson said after last week’s court hearing that the white separatist movement is over in Leith. She has posted an appeal for money on a White Nations website asking supporters to donate money to a New Leipzig bank account to have water and sewer installed in Cobb’s house.

      A 30-day period for Cobb to come into compliance with a new water and sewer ordinance in Leith expired Saturday.

        Leith city officials hope to move quickly to demolish a house owned by white separatist Craig Cobb as well as other condemned properties.

        Cobb is in jail on charges of carrying a gun and terrorizing Leith residents; meanwhile a 30-day order to get water and sewer to the property expired Saturday.

        Leith Mayor Ryan Schock said the city is waiting for attorney Tom Kelsch to prepare condemnation paperwork, which may include evicting Deborah Henderson, the girlfriend of a white separatist who’s been living in Cobb’s place along with her three children.

        Her boyfriend, Kynan Dutton, also is in jail for the same charges.

        Schock said the town is anxious to remove the house, now that it’s officially out of compliance with a new city ordinance.

        “Yesterday (Monday) would have been late,” Schock said.

        The house doesn’t have a working furnace, water or sewer. Henderson has said she has nowhere else to go. She’s put out on appeal on a white supremacist website asking for $12,000 to get the house up to code and says people can send money to her, or to a special bank account she set up at Dakota Community Bank in New Leipzig.

        City councilman Lee Cook said it’s too late.

        “There’s no plan (submitted to Custer District Health and approved by the city), no nothing. It’s over,” Cook said.

        “The reality is, those three kids shouldn't be living in that house. There are shelters and people who evidently want to help her out,” he said.

        He said the company he works for, Weisz and Sons, of Bismarck, has agreed to provide equipment and manpower to remove the condemned structures. Besides Cobb’s house, there are 10 or so other properties that will be demolished, including the abandoned old creamery next door to Cobb’s house that he also purchased.

        He said the company wants to help Leith, but may wait until it can do all the demolition at the same time.

        “We need to get some (legal) questions answered. I see it happening sometime after the first of the year,” Cook said.

        Henderson did not return a contact from the Tribune for this story. Nor did attorney Kelsch.

        Cobb told the Associated Press he is still seeking a form of food-deprivation spiritual enlightenment that ends in death, and he does not expect to be around for his next court appearance on Jan. 13. He said he is leaving his property in Leith to nationalist parties in Greece, France and Hungary in an attempt to carry on the Leith movement.

        However, Mercer County Sheriff Dean Danzeisen said Cobb is eating meals and drinking Ensure. “Sometimes he doesn’t finish his plate, but he is eating,” the sheriff said.

        “I just talked to him yesterday (Monday). He’s in decent spirits, keeping busy writing letters and making phone calls. He isn’t causing any grief or trouble around here.”

        The city’s been trying to fend off Cobb’s plans to turn Leith into a white stronghold and take over the town’s government.

        The ordinance requiring water and sewer for all occupied residences was aimed at controlling how people could live in town.

          After being denied a restraining order by a court judge Monday, the girlfriend of a white separatist in Leith was back with another signed order Tuesday, this time served against her neighbor and city councilman, Lee Cook.

          Deborah Henderson wants a court judge to stop Lee Cook from pointing an outdoor security camera toward Craig Cobb’s house, where she is living with her three children, and from being what she calls a “voyeur.“

          A hearing on the order is scheduled for Dec. 30 at the Burleigh County Courthouse in Bismarck.

          In the request, Henderson said Cook calls her names and on one occasion screamed obscenities at her from the bar in Leith.

          Cook said he was installing security coincidentally the same day her boyfriend, Kynan Dutton, and Cobb, approached him while on what they said was an armed patrol of Leith. The two, at Cobb’s instigation, planned to take over the town for other neo-Nazis. Henderson followed the men with a video camera to record the patrol.

          That was Nov. 16. That afternoon, both Cobb and Dutton were taken to jail and remain there on seven counts of terrorizing Leith residents.

          Cook said he’s never been in the Leith bar and the cameras provide security in all directions from his house, including the road toward Cobb’s that the men walked down toward him carrying guns.

          “I’m not taking it down,” Cook said.

          A judge on Monday dismissed a restraining order Henderson sought against the Leith website developer.

            Tom Metzger, a former Ku Klux Klan grand dragon and one of the most radical white separatists in the country, said he'll deed a lot he owns in Leith back to the town depending on what happens to Craig Cobb.

            Cobb, along with housemate, Kynan Dutton, is in jail on seven charges of terrorizing Leith residents while on an armed patrol to protect his property.

            Cobb hopes to turn Leith into a neo-Nazi stronghold and purchased 13 lots, including his house that may soon be condemned under the town's new ordinances.

            At the height of his all-white takeover campaign in Leith, he deeded a lot across from the town bar over to Metzger, which Metzger said Thursday he viewed as a "wild blue yonder" kind of a deal.

            Now, he'll give that property back to Leith if Cobb gets out of jail with a slap on the wrist or credit for time served, he said.

            If the system puts the hammer down and Cobb ends up with 10 years' imprisonment, or similar, Metzger said Leith can expect the worst.

            "I'll keep the lot until hell freezes over and they'll get the propaganda capital of the world. I can psychologically keep Leith on the map for the next 10 years," he said.

            Grant County State's Attorney Todd Schwarz said he doesn't bargain with threats.

            "The criminal courts are not the place to be negotiating with a threat. That's inappropriate," said Schwarz. "What happens would be up to a jury, very likely."

            Metzger, now of Indiana, has been involved in white supremacy for decades. He and an organization he founded, White Aryan Resistance, were ordered to pay $12 million for influencing a racially motivated murder.

            Metzger said he's known Cobb for years and finds him likeable and intelligent, if a little off the wall. "He is eccentric, there's no doubt about that," he said.

            He said he endorsed Cobb's early plans of bringing out-of-work white men to Leith to work the oil field because it fits his "lone wolf" philosophy of quietly working, fitting into a community and staying off the radar.

            "All of a sudden there were flags and parades and guns. I told him don't get into this stuff, you do one little thing and they'll come down on you like gangbusters."

            He said it was unfortunate Cobb's vision for Leith was co-opted by the "old right wing."

            Metzger said that wing is characterized by people like "commander" Jeff Schoep of the National Socialist Movement, who called a town meeting in Leith, hung swastika flags around town, sparking a protest rally.

            "He's a tin-man Nazi, we call them Hollywood Nazis," Metzger said.

            Metzger said he keeps up with Leith news and is aware that Dutton's girlfriend, Deborah Henderson, is still in Cobb's house with no furnace, running water or sewer, along with her three children.

            "The best thing she could do is go back home," he said.

            Henderson faces possible eviction now that Cobb's order to bring the house up to code has expired.

              White separatist Craig Cobb will remain in jail without bond though his follower who’s jailed with him could be released if he can come up with $50,000 in cash.

              Cobb, 62, and Kynan Dutton, 29, appeared for a bond review hearing in a courtroom in Stanton Monday morning, both wearing orange jackets and orange tennis shoes over their green jail uniforms.

              They’ve been held in the Stanton jail without bond since Nov. 16, when they were arrested on seven charges of terrorizing residents of Leith while on an armed patrol of Cobb’s property in town. Cobb and Dutton were planning to take over the community in a show of all-white control.

              The men have different attorneys who each made a case to set some bond so the accused could leave jail during upcoming court proceedings on the terrorizing charges.

              Cobb’s attorney Ryan Heintz, the fourth to be appointed in the case, asked South Central District Judge Bruce Haskell to set bond at $50,000. Heintz said he’d agree to an order preventing Cobb from coming within 100 feet of his alleged terrorizing victims.

              Grant County State’s Attorney Todd Schwarz said Cobb is already a fugitive on hate crime charges in Canada and if bond were set, it should be in the range of $1 million to prevent him from running and on condition that he can’t enter Leith.

              Haskell, who was on a live video feed from a Bismarck courtroom, said he would continue Cobb’s no bond status because of the Canadian warrant and because the charges involve threats against individuals.

              He said the men are scheduled for preliminary hearing and more details of the case will be apparent at that time.

              Dutton’s attorney Robert Quick said Dutton has no criminal history and wants to spend time with his girlfriend, Deborah Henderson, and her children.

              Henderson moved out of Cobb’s house in Leith over the weekend and is still in North Dakota, though not Grant County, according to Schwarz. Cobb’s house may be condemned by the Leith City Council because it doesn’t have water or sewer as required by new ordinances.

              Leith City Councilman Lee Cook said the city is waiting for a condemnation order to move ahead with demolition.

              Schwarz said Dutton also is a flight risk because he has “zero ties,:” now that his girlfriend is out of Leith.

              He said any bond for Dutton needed to be high enough to prevent him from running.

              Haskell said Dutton isn’t being sought on other charges and he was considering the safety of the community and flight risk, not social or political issues, in Dutton’s case.

              He said Dutton would have to post the entire $50,000 in cash before leaving jail and would be required to appear in court, remain in contact with his attorney and have no contact with his alleged victims or their families if he leaves.

              Cobb appeared to have some trouble collecting his thoughts and said he’s on his seventh day of a liquid-only diet.

              He had been refusing food and spent two weeks of his incarceration at the State Hospital in Jamestown.

                White supremacist Craig Cobb may get a chance to celebrate the new year as a free man. The North Dakota Supreme Court Tuesday ordered that district judges issue an order setting reasonable bail with reasonable conditions for Cobb.

                This overturns a decision by district judges in south central North Dakota denying Cobb bail while he faces 7 charges stemming from a November arrest when he allegedly threatened residents of Leith, North Dakota with guns.

                  The North Dakota Supreme Court has weighed in on the Craig Cobb matter and says the white separatist jailed on seven counts of terrorizing Leith residents has a right to bond.

                  The court filed the documents Tuesday and said the district court should set a reasonable bond by Friday, even though two court judges had already decided to hold him without bond, one as recently as Monday.

                  Cobb requested the higher court’s intervention.

                  Kynan Dutton, a follower of Cobb who was also charged in the terrorizing incidents, was granted a $50,000 cash bond at Monday’s hearing, the same day South Central District Judge Bruce Haskell said Cobb should remain in jail. The judge based that partly on the fact that Cobb is a fugitve from hate crime charges in Canada.

                  The court said there’s no evidence in Cobb’s case to support no bond, a situation usually reserved for a capital offense.

                    BISMARCK - The North Dakota Supreme Court has ordered a judge to set “reasonable bail with reasonable conditions” for a white supremacist who has been held without bail since his arrest last month for allegedly terrorizing residents in the small town of Leith.

                    A bail hearing for Craig Cobb is set for 2:30 p.m. Friday in Bismarck before Judge Cynthia Feland via interactive television.

                    Judge Thomas Schneider originally ordered Cobb held without bail on Nov. 18 in Grant County District Court. Judge Bruce Haskell extended that order during a hearing Monday, at the same time setting cash-only bail at $50,000 for Kynan Dutton, who along with Cobb is charged with seven felony counts of terrorizing for allegedly approaching Leith residents with loaded firearms on Nov. 15 and 16.

                    Cobb asked the Supreme Court last week to intervene, but the high court decided to reserve judgment pending the outcome of Monday’s hearing.

                    In an order filed Tuesday, justices granted Cobb’s request, referring to a section of the state Constitution that requires bail for all defendants “unless for capital offenses when the proof is evident or the presumption great.”

                    The Supreme Court also noted there’s no evidence in the court record of an extraditable Canadian offense for which Cobb can be held without bail, which the Bismarck Tribune reported was part of Haskell’s reason for continuing Cobb’s no-bond status.

                    Cobb fled to the United States after being charged Dec. 31, 2010, in Vancouver, British Columbia, for the willful promotion of hatred. Authorities have said Cobb can’t be extradited back to Canada because there is no similar U.S. law for the offense.

                    The high court ordered the district court to set bail no later than Friday.

                    Cobb and Dutton remained jailed in Stanton on Thursday afternoon.

                    Cobb moved to Leith and made plans to turn it into a whites-only community. He was later joined by Dutton.

                    Leith Mayor Ryan Schock said he believes Cobb's bail should be set at $1 million, cash only.

                    “If he gets out, he’s either going to flee or he’s going to come and hurt somebody. It’s just plain and simple. That’s my concern, I guess,” he said.

                    A message left for Cobb at the jail was not returned.

                    Meanwhile, the city of Leith is trying to condemn Cobb's house after he missed a Dec. 14 deadline to have sewer and water service installed as required by a uniform building code approved by the City Council in early November, after Cobb's plans became known.

                    Schock said Thursday he was still waiting for the condemnation paperwork from City Attorney Thomas Kelsch and hoped to have it by the end of the week. A message left for Kelsch was not returned.

                    The city plans to demolish Cobb's house, along with several other structures identified by Custer Health as public nuisances in the town of about 20 people 75 miles southwest of Bismarck. Schock said they would like to raze all of the structures at the same time.

                    The city had planned to evict Dutton's girlfriend, Deborah Henderson, from Cobb's home, where she lived with her three children, but she left on her own, Schock said.

                    Reached by phone Thursday, Henderson said she didn’t leave Leith because of the pending eviction. She said she couldn’t comment on why she left, adding, “But I think it’s pretty obvious.”

                    She declined to disclose her location or plans.

                    "I did what I needed to for the safety of me and my children,” she said.

                      White separatist Craig Cobb can leave jail if he can come up with $1 million in cash, a district court judge said Friday.

                      Cobb, who's been jailed in Stanton since Nov. 16 on seven counts of terrorizing citizens during an armed patrol of Leith, appeared on video before South Central District Judge Cynthia Feland.

                      The bond hearing was required by the North Dakota Supreme Court, which issued a Christmas Eve order that Cobb is entitled to reasonable bond after two district judges denied him any bond pending his court proceedings.

                      Feland said if Cobb puts up the money he could have no contact with any of the seven alleged victims and must meet other conditions, including remaining in North Dakota unless he has permission to leave and showing up for all scheduled court appearances.

                      Cobb leaned up to the microphone and asked Feland, “Where do I pay the $1 million?” and then leaned back with a wide grin.

                      The judge said the bond money would have to be deposited with the clerk of court.

                      In an earlier exchange with the judge, Cobb started to explain events leading up to the patrol and the judge cautioned him that his attorney was advising him not to talk about the case, only his bond issues.

                      Cobb did tell the judge he would be willing to wear a tracking device. Prior to the hearing's start, Cobb told the Tribune he would not return to Leith if he leaves jail. Instead, he would get an address in Mandan, he said.

                      In setting the $1 million bond, Feland said she was concerned about public safety and the fact that Cobb fled Canada after being arrested on a hate crime charge.

                      Cobb’s attorney Ryan Heintz recommended a $50,000 cash bond, the same as was applied to Cobb’s follower, Kynan Dutton, in a hearing earlier this week. Dutton accompanied Cobb on the patrol and is charged with the same felony terrorizing counts. The two planned to take over Leith in an all-white, neo-Nazi movement.

                      A district court judge said Dutton doesn’t have a flight history and said he could leave jail if he comes up with the cash.

                      Dutton was still in jail at Stanton Friday, said Mercer County Sheriff Dean Danzeisen. Cobb told the Tribune he continues to deny himself food and is subsisting only on water while in jail.

                      The two men are scheduled for a preliminary hearing Jan. 13.

                        BISMARCK, N.D. (AP) — North Dakota's Supreme Court has admonished a district judge for withholding evidence when she worked as a prosecutor.

                        A disciplinary panel had recommended that Judge Cynthia Feland be suspended from practicing law for 60 days.

                        The Supreme Court's ruling admonishes Feland for her conduct. That is a less severe penalty and won't hurt her ability to continue serving as a judge.

                        The justices say Feland has to pay part of the cost of the disciplinary investigation.

                        The complaint was made in the case of former state workers' compensation director Sandy Blunt. When Feland was a prosecuting attorney, she pushed to convict Blunt for misusing agency funds.

                        The Supreme Court says Feland didn't turn over a document to Blunt's defense lawyer. But the ruling says the omission didn't harm Blunt's case.

                          A judicial referee has dismissed a disorderly conduct restraining order filed against a Leith city councilman.

                          Deborah Henderson, the girlfriend of a white separatist in Leith, sought a restraining order against Lee Cook, a Leith city councilman. She alleged he called her crude names and harassed her by putting up a surveillance system. Judicial Referee Wayne Goter on Monday dismissed a temporary restraining order and did not put a permanent order in place in the case.

                          “I don’t know what has transpired here,” Goter said. “I don’t have enough evidence to say who said what.”

                          Henderson moved to Leith in October with her boyfriend, Kynan Dutton, and their children to join Craig Cobb in an attempt to turn Leith into a all-white enclave. Dutton and Cobb have been in jail on terrorizing charges since Nov. 16 in lieu of bond. Henderson has moved out of Leith.

                          Henderson filed for the restraining order against Cook on Dec. 17. She said Cook had called her crude names from in front of his own home, from in front of the town’s bar and during the dispute that led to Dutton’s and Cobb’s arrests in November. She said he had threatened to kill his dog after it went into her yard. She also alleged that a surveillance system that Cook installed on Nov. 16 was pointed at her home and violated her privacy.

                          “We are not of the same political views,” she told Goter. “I am a separatist, and we are not really liked or wanted.”

                          Goter questioned whether the surveillance system was any different than if Cook would sit on his front porch and watch her house. She conceded it was not.

                          “I just want this to stop,” she said. “I want to be left alone.”

                          Cook said the surveillance system was an unsophisticated one purchased at a Bismarck hardware store that did not clearly show Henderson’s home, approximately 250 feet from his own. He said he put it up due to tensions in the town related to Cobb’s plans and because his home was sometimes sitting empty because his family would not stay there when he was gone.

                          “My family hadn’t even lived at home for two months,” Cook said.

                          He said the fact that he was putting up the surveillance system the same day Cobb and Dutton ended up getting arrested was coincidental. And he alluded to Henderson’s involvement in the incident, in which she videotaped Cobb and Dutton walking around town with loaded weapons.

                          “And she should have been charged,” Cook said. “I’m not sure why she wasn’t.”

                          Cook also denied using any coarse language to describe Henderson and said he rarely curses. He also said the only time he has been in Leith’s bar was for a recent city council meeting, making it unlikely that he would have been outside the bar making comments about Henderson.

                          “It’s a flat-out lie,” he said.

                          Goter had to interrupt both Henderson and Cook during the hearing to keep them focused on the topic at issue in the restraining order. He also had to tell Henderson several times that if she asked Cook a question, she was not allowed to argue with his answer.

                          Goter said the security camera issue would not have warranted a disorderly conduct restraining order, but said he has issued restraining orders in cases of chronic name calling among neighbors. However, Henderson’s and Cook’s recitations of the situation were inconsistent with each other, and Goter said he had nothing on which to determine who was more credible.

                          Henderson previously sought a disorderly conduct restraining order against the Leith website developer, but that, too, was dismissed.

                            BISMARCK, N.D. — A small North Dakota town targeted for takeover by a white separatist who now sits in jail on terrorizing charges has backed away from plans to condemn and raze his home, after a woman living there moved out and left it unoccupied.

                            Craig Cobb and fellow white supremacist Kynan Dutton had been living in the home with Dutton's girlfriend, Deborah Henderson. Cobb and Dutton both are jailed for allegedly terrorizing residents with guns — claims they reject. Henderson has moved out. Cobb says she went to northern South Dakota, but Leith Mayor Ryan Schock says residents believe she's in Mandan. Henderson declined to say.

                            Leith attorney Tom Kelsch says the town has backed away from plans to demolish Cobb's house because an unoccupied structure can't be condemned under city ordinance.

                                CARSON — The defense for two white supremacists charged with using long-barreled guns to terrorize residents in the small town they planned to take over said the guns were legal and the men neither acted violently nor made verbal threats.

                                In a Grant County courtroom full of spectators, media and residents of Leith, attorneys for Craig Cobb, 62, and Kynan Dutton, 29, asked South Central District Judge Donald Jorgensen to dismiss charges for lack of evidence, or reduce them to disorderly conduct.

                                Jorgensen instead ordered a trial, which is expected to last two to three days, and said he would entertain motions next week to reduce bond now set at $1 million cash for Cobb, and $50,000 cash for Dutton.

                                No date for the trial has yet been set.

                                Neither man spoke in court, except to plead not guilty to all seven felony terrorizing charges against Leith residents.

                                The only witness in Wednesday’s preliminary hearing was Grant County Deputy John Foss, who was on the stand for more than hour being questioned by Grant County State’s Attorney Todd Schwarz and attorneys for Cobb and Dutton.

                                The charges involve incidents that occurred over a mid-November weekend, most of them after Cobb notified the Grant County Sheriff’s Department that he would be making armed patrols of Leith to protect his property, Foss said.

                                Cobb purchased a house and 12 other lots in Leith and in August publicized his plans to fill the town with other white supremacists and take over the town government.

                                Prior to the armed patrol, Leith, population 24, had already experienced a loud anti-neo-Nazi protest over a town hall meeting staged by the commander of the former American Nazi Party, now the National Socialist Movement. Dozens of armed police officers and a riot squad were in Leith to control the situation that day and several other white supremacists were coming and going from Cobb’s residence. Nazi flags and racially slurred signs were becoming part of the town’s landscape.

                                The commander, Jeff Schoep of Detroit, was at the hearing Wednesday to support Cobb and Dutton.

                                He said afterward he doesn’t endorse their behavior, but he said he foresees a potentially dangerous precedent of arresting people only because others are afraid.

                                “No criminal action took place,” Schoep said.

                                If the judge reduces bond, he said, “We’ll do what we can to help.”

                                State’s Attorney Schwarz said the episodes had to be viewed in the context of violence escalating to the point where guns were being carried on the streets and people were afraid for their lives.

                                Foss said during the incidents, Cobb carried a pistol-grip shotgun and Dutton carried a military-grade rifle in “at ready” position.

                                “It was kind of like a mission,” Foss said.

                                He described the victims as scared, shaken and feeling fear for their lives.

                                In one of the incidents involving the Rev. Paul Ferrie and his wife, Miller Ferrie, Foss said, “they felt at any moment it could have gone bad.”

                                He said Cobb, Dutton and Dutton’s girlfriend, Deborah Henderson, followed Miller Ferrie down a street in Leith, insulting her religion, and then encountered Paul Ferrie when he came outside their home.

                                In that encounter, Foss said, Cobb appeared “enraged.”

                                He based his remarks on interviews and on the video footage taken by Henderson during the patrols. The videos were turned over to police and also showed up on YouTube. They were not shown in court Wednesday.

                                The other incidents involved rural Leith resident Barry Streigel, who was taking pictures of signs the men had posted on Cobb’s property, the nearby farm family mother-daughter pair of Bethany and Akriti Haberstroh, who stopped their vehicle on a Leith street to prevent running over Dutton’s loose dog, and Gregory Bruce and Leith city councilman Lee Cook, who were outside installing security equipment on Cook’s house.

                                No words were exchanged in the encounter with Bruce and Cook, though both men called 911 when they saw Cobb and Dutton carry weapons up to the edge of Cook’s property.

                                Foss said it is legal to openly carry weapons in North Dakota. He said none of the victims had said they were verbally threatened in the incidents.

                                The weapons were not taken when Cobb and Dutton were arrested, but Foss said they were picked up later by police and one had a chambered round of ammunition.

                                Cobb’s attorney, Ryan Heintz, said the men were within the law to carry weapons and the case was built largely on subjective feelings in a tense situation.

                                “This is not a court of morality, it’s a court of criminal action. You don’t have to agree with their point of view, but look at their actions at the time,” Heintz said. “There were no crimes here.”

                                “Although their actions were not fitting in what most people would expect in a small North Dakota town, their actions were not illegal,”Heintz said.

                                Dutton’s attorney, Robert Quick, said he thought his client’s actions made a case for disorderly conduct.

                                “That’s what it sound like, not terrorizing,” he said.

                                Schwarz said, “Disorderly conduct with guns makes a case for terrorizing.”

                                Quick asked the judge to reduce Dutton’s bond to $20,000, with 10 percent cash.

                                He said Dutton’s girlfriend, Henderson, has left Leith and lives in an undisclosed location in the area, where she has a job and has enrolled her children in school.

                                “He has zero criminal history. He is a veteran. He has no intent to leave while the case is pending,” Quick said.

                                Heintz asked the judge to reduce Cobb’s bond from $1 million to $50,000 cash.

                                “He has a very sparse criminal background,” Heintz said. Cobb is a fugitive from a hate crimes charge in Canada.

                                Leith resident Sherrill Harper, whose husband, Bobby Harper, is the only black resident in town, said it was hard to listen to the defense suggest the residents were at fault.

                                She said she hopes the judge leaves bond where it’s set.

                                “I really believe that if Cobb gets out, he will flee,” she said.
